FurBid(SM) Policies and User Agreement

Read this! Use of FurBid constitutes full agreement and understanding of the Policies of FurBid

Registration: The registration process creates your bidder/seller record, which keeps track of who you are, where you live, what you've bid on and what you've sold. All FurBid users are required to maintain accurate and complete contact information in their account(s). The only person who shall see part of your record is the seller of items you bid on, and only if you get the highest bid. The information revealed to the seller in this case would be your address, so the seller knows where to ship the item. Your records are private and shall not be disclosed/sold/leased/etc. to third parties (see below for exceptions).
Note: It is vital that all information in your record is accurate. If there is an inconsistency in your record, such as your address being wrong, the items you bid on will not get to you, or payment won't be received from your buyer.
Username Note: Vulgar, racial, ethnic, or otherwise potentially offensive terms are not to be used in usernames. This includes both actual spellings, phonetic spellings, sounds like spellings, 1337 spellings, or any method which may be seen as an attempt to circumvent this policy. If you are uncertain about any possible username, please do not hesitate to ask.

Bidding: By bidding on an item, you are signing a legally binding contract with the seller, in which you acknowledge you have adequate funds available to purchase the item. Upon close date being reached on an item, or 10 minutes after the final bid on the item (whichever occurs later, as determined by FurBid's server clock), the item shall be marked as closed by the software. At that time, an e-mail will be sent to the seller, informing them that the item has closed, what the final bid was, and providing contact information for the highest bidder. The highest bidder is REQUIRED to pay the seller the agreed-upon price (the highest bid). Failure to pay the seller upon auction close constitutes fraud, a criminal offense.
The final highest bid is determined by the auction script's determinations of when the final bid was placed. All highest bids are final; if a debate arises over who got the highest bid, it is the seller's responsibility to work it out. All disputes over highest bids shall be ignored by the site administrator. FurBid takes no responsibility for bidders misrepresenting themselves in order to unscrupulously acquire an item.

Currency: FurBid only accepts items to be listed in US Dollars (FAQ).

Bidding on ones own item (Shill Bidding): It is against the policies of Furbid for any seller to bid on their own auction listings. If the seller is found to be willfully bidding on their own auctions in order to drive up the price of their auction, the auction will be considered invalid, the seller will be warned, and may be suspended or banned at the discretion of the Administration.
Note: This clause does not apply to the "starting bid" on the auction (prefixed by the word "Start:" in the bidding history). This bid is automatically generated by the auction software when an auction is created.

Bid Rigging: The opposite of shill bidding, this term refers to the unlawful practice of two or more persons agreeing not to bid against each other in an effort to deflate prices at an auction. Any bidder/bidders found to be participating in bid rigging in order to lower the price of an auction may be warned, suspended or banned at the discretion of the Administration.
Just as a buyer would not want a seller to shill, a bidder has no right to rig.

Bid Shielding: Also known as Bid Screening, this term refers to an unethical practice at on online auction site whereby a person places a nominal bid on an item and arranges for a confederate to soon thereafter place a high bid to discourage other bidders. The confederate waits until the last moment before the auction ends and retracts his bid. Thus, the original bidder can purchase the item at an undervalued price. Any bidder/bidders found to be participating in bid shielding in order to lower the price of an auction may be warned, suspended or banned at the discretion of the Administration.

Bidding on adult-rated material: The adult categories are restricted to bidding by legal adults only! By bidding on items under the adult categories, you acknowledge that you are of legal age to do so. Do NOT bid on items in the adult category unless you are of adult age for the country of your origin. FurBid will not be held responsible for the sale of explicit content to minors.

Sniper Bidding: To attempt to control the practice of sniping, in which a buyer will bid in the last few seconds of an auction in order to ensure a victory, FurBid's software will hold an auction after close for ten minutes. During that time, additional bids may be placed on the auction. Each time a bid is placed, the clock is reset to 10 minutes. Ten minutes after the final bid, the auction will be closed completely. In theory, this feature works consistently. If it's a little off, it may be due to the server clock drifting, or your browser taking too long to submit the bid. FurBid really can't do much about that, sorry.

Non-payment (deadbeat buyer): If a buyer bids on an item but does not pay the seller, the buyer is a deadbeat bidder. It is against FurBid's Terms of Service to place joke bids or to bid and not follow up with payment. Sellers may report deadbeat bidders to the Administrator; three complaints and the buyer's account will be suspended. Buyers are required to maintain communication with their seller as to the status of payment.

Selling items: All items listed on FurBid (whether sold or not) must be of an anthropomorphic related nature. For the purposes of this clause, anthropomorphic is defined as "Anthropomorphic or therianthrophic in nature". Sellers must provide accurate and complete information about the item they are listing and be permitted to sell the item they are listing, under the law of their country (that means no underage users attempting to sell adult items, for one!). Every state and country has its own age of consent; if unsure what the age is for your area, please ask someone who knows. All material that is adult in nature MUST be sold under the appropriate categories; see the section "Definitions of Category Ratings" for ratings descriptions.

Copyrighted characters/ lyrics: No seller may sell any art, music, video or other product containing copyrighted characters or lyrics, without the copyright holder's express written permission. This includes Parody work. The only exception is if the seller is simply reselling "original material" created by the copyright holder, meaning that the item is not a derivative work of another item, and the characters/lyrics/etc are not used without permission. Sellers are required to submit to FurBid upon request of the Administration proof of such written permission, which may be verified through its source. Failure to do such will be treated as a violation of the ToS and copyright law. Please take the time to check the Furbid FAQ for an explanation of fanart, parody art and cosplay.

Non-shipment (deadbeat seller): If a seller received payment for an auction but does not ship the item within a reasonable amount of time (being defined as one month for domestic shipments, and two months for international shipments), the seller is a deadbeat seller. It is against FurBid's Terms of Service to not ship an item that has been paid for. The buyer may submit a complaint of non-shipment to the Administaur; three complaints and the seller's account will be suspended. This clause excludes items in which the buyer has not met the auction's reserve price. Commission auctions normally take longer, so are limited to one year instead. Sellers are encouraged to maintain communication with their buyer as to the status of shipment either way.

Definitions of Category Ratings
Please refer to the following descriptions for a general overview of what FurBid's interpretation of the Rating System is. All users listing any auctions on FurBid are expected to adhere to these categories. Failure to do such will be treated as a violation of the FurBid ToS.

Improper Placement of Listings: Any listing found to be in the wrong category will constitute a warning message to the seller and may be moved or deleted from the server by the Administration. In the cases where the Administration chooses to move the auction, the warning message will be sent automatically by the FurBid mail program to inform the seller of the move. It will not include the reason why the listing was moved. If there is a question as to why, the Seller is responsible for contacting the Administration and asking why in private email.
If the seller continues to place listings in the improper areas, they may be suspended or banned from FurBid permanently at the discretion of the Administration. Any attempt to circumvent a suspension will result in immediate and permanent banning. This policy is to protect our younger viewers (face it, not every user is a legal adult) and to protect FurBid from lawsuit pertaining to pornography peddling.

Dutch Commissions: Auctions in the Commissions categories must be limited to single winner. In most instances, they must be limited to a single item per auction. The only allowable exceptions at this time are treating sketchbooks and animations as single items.

Charity Auctions: Due to strict California State laws regulating fundraising, including auctions for charity, and the requirements regarding such. It has been decided that no auctions for charity will be allowed on FurBid. It has also been decided that any auction which uses the word charity, or words that imply charity, in it may be deleted without notice.

Child Pornography/Pedophilia: FurBid will not tolerate Child Pornography or pedophilia under any circumstances.
Note: The Administration is aware that art and its interpretation is a very subjective matter. It is open to interpretation. As such is the case, the Administration is often required to make hard judgement calls. We, the Administration, are aware artists and users will not always agree with our interpretations. We will make every attempt to be fair and just when dealing with subjective interpretations. When we make these hard calls, please trust we came to the conclusions with the best interests of the Furbid Community as a whole.
Please use common sense when listing or bidding on auctions. If you have a question if an item is acceptable, please do not hesitate to ask us. We will be more than happy to help you.

Bestiality is Expressly Prohibited: Any art, video or other item that depicts bestiality (sexual or other adult situations between a humanoid and an animal) is *not* allowed on FurBid, period. A first violation will result in the seller being warned, and the offending auction(s) being immediately suspended. Repeat offenders may be banned permanently from FurBid. Please, use good judgment in posting your items.
Note: For the purposes of this clause, The Administration has decided that Furbid defines Taurs (Centaurs, Felitaurs, Chakats, Etc) as Humanoid and/or Morphic Creatures.

Endangered Species: Sale of any species, in part or in whole, protected by the Endangered Species Act of 1973, is strictly forbidden. Any item listed found in violation of this policy will be removed from listing and logged for future reference. Second time offenders may be suspended or banned.
Why So Harsh?: According to Provision (F) of Sec. 1538 of the ESA, FurBid could be held liable if items of this nature are sold via the FurBid service.

Hate Art Is Forbidden: Any art, video, or other item that depicts hate art, ethnic or racial slurs, religious slants, or any form of hate toward any group without holding some form of artistic or socially redeeming commentary, is subject to removal without warning. This will be left to the discression of the Administration to determine. Further listings of the same, or related items after removal may result in loss of account priviliges.
Note: For the purposes of this clause, Art created with a harassing nature, aimed at a specific person, group, or organization, with harassment in mind, will be treated as Hate Art.

Warranty: FurBid does not validate the condition of items offered for sale, and as such there is no warranty offered by FurBid that your purchase shall arrive intact and matching the seller's description. By registering an account you absolve FurBid, FurBid.ws, and its parent companies and maintainers of any and all damages, loss of property, fines and errata charges resulting from your use of FurBid. If you have been defrauded by a seller (or bidder), contact the law enforcement authorities in your local area.

Feedback System: Both buyers and sellers are encouraged to make use of the feedback system provided by FurBid. The Administration of FurBid will not intervene in any dispute with feedback left by either side unless said feedback violates FurBid's polices. This includes, but is not limited to, foul language, distribution of personal information, threats, defamatory comments, or anything interpreted by the Administration as a violation. Abuse of the feedback system will not be tolerated and may result in temporary suspension or banning.
Note: The feedback system will only allow feedback to be left for ninety days after the auction's end.

Discussion Board: FurBid maintains an official discussion board | here |. No other board found is considered official by the FurBid Administration. It is the duty of all members of FurBid to periodically check the board for updates.
Note: The Administaur does maintain a private Livejournal under the username Ayukawataur.

Image Hosting Service: FurBid provides an image hosting service for the use of its members. This service is for use in FurBid auctions only. Use for any other purpose, may result in the deletion of the image from the FurBid server. Bandwidth piracy will not be tolerated.

Violations of Policies: FurBid's User Policies is a legally binding contract between you and FurBid, and you are responsible for following the terms outlined in the User Policies as long as you are a member of FurBid. If you believe a user is violating FurBid's User Policies, or if you have a policy question, please e-mail furbid@furbid.ws
FurBid administrators may edit or delete auctions for any reason, including, but not limited to, violation of the ToS.

Administrative Emails: On occassion the Administraion may need to send out emails to all members. The system used by Furbid emails every active member in the database. As such it is currently required for all members to allow email from Furbid. Any requests to be removed from Furbids email list will require removal as an active member from the system.

Changing of TOS: As the situation mandates, FurBid may change this TOS as needed at any time. FurBid administration will make every effort possible to alert its users whenever the TOS changes - All changes will be announced in the Administaurative-Announcements section of the Official Discussion Board. The User acknowledges that FurBid administration may not be able to alert users at times, due to adverse network conditions, wars, or Acts of God. It is the User's responsibility to periodically check the TOS for updates, as by continuing to use their account constitutes agreement to the entire TOS. If at any time the User cannot agree to the TOS, the User must follow the process of account cancellation as detailed below.

Canceling your account: If you ever wish to cancel your FurBid account, send an e-mail to furbid@furbid.ws, with the subject "Account Cancel". The message must be sent from the address you registered with. In your message, include the following: you name, complete address, and password as they appear in your registration details. This will allow us to verify that you are who you say you are (i.e. not trying to close another user's account).

Auction software errors: Occasionally, due to either programmer error, machine error, bidder error, and/or webmaster error, a bid may either be placed after an item is officially closed, or an auction may close too early. By using FurBid, you agree that such errors are unintentional and agree to hold FurBid and all entities connected to FurBid harmless. FurBid administration shall do its best to fix the problem to prevent its reoccurrence. If you encounter such an error, let furbid@furbid.ws know, so that we can make this site the best it can be.

Governing law: This agreement will be governed under the law of the State of California and the United States of America. By creating or using an account, you agree to be bound by said laws for all use of this site.

Administrative Interpretation: FurBid Administration reserves the right to interpret any and all policies of this ToS. They also reserve the right to arbitrate any situation in which a policy may not exist. All users of the FurBid system, whether registered or not, agree to respect and abide by any directives or decisions made by the Administration. Failure to do such may result in suspension or termination of their account.

Privacy: FurBid, in the course of facilitating sellers and buyers coming together to make a transaction, stores and collects some information. FurBid does not and will not disclose any identifying contact information or usage statistics to any third party, unless required to by law or by a mutual partnership. IP addresses are collected for users requesting their username and/ or password be retrieved for them. What items a user sells or bids on are stored by FurBid for the sole purpose of sending e-mails to buyers and sellers (to announce the close of an auction they bid on/sold), as well as to help FurBid defend or refute claims of fraud by one party against another (or against FurBid). Information collected in the course of using FurBid will be disclosed to no one, with a few exceptions (please read Disclosure Exceptions, the next section)

Disclosure Exceptions: FurBid respects the privacy concerns of all its users, and goes to great lengths to protect that information from any third party that should not have access to it. We will disclose the following information to another user, if and only if they were a buyer on an item you were selling, or a seller whose auction you bid on: name, e-mail address, postal mail address. No other information will be disclosed, unless required to do so by local, state, federal or international law.

User behavior: FurBid is a multi-user service. All users, whether buying or seller items on FurBid, are expected to conduct themselves in a manner befitting a legally binding business transaction between two or more parties. FurBid will not tolerate any user of FurBid (or anyone acting on their behalf) to harass any FurBid user via e-mail, telephone, or any other communication medium, for any reason. Harassment includes: mail bombing, making threats of physical/mental violence, making obscene or hateful statements to the person(s), or making the user afraid to share information about their auction transaction with the harasser(s) (via user feedback or other medium). If legitimate harassment can be proven, the harasser(s) will be warned one time. A second offense will lead to a permanent ban of the user from FurBid. If you can't at least play at being nice, we don't want you as a user, and we have no obligation to have you as one.

Copyright of site content All images and text on this site, with the exception of auction preview images and auction descriptions, are copyright FurBid, Miyagami Noriko. Any material submitted to FurBid by a user remains the property of its owner, whether it was used with permission or not. The names "FurBid" and "FurryBid", and the FurBid logo may only be used for discussing FurBid or promoting auctions on FurBid, and may be used for no other purpose. The banner graphics on various pages are copyright their respective creators. No image may be reused, distributed, sold, leased, altered or duplicated without written from FurBid administration or its respective owner. The exception is any graphic specifically provided for link-to purposes, for placement on a User's site to link to FurBid. These graphics may only be used to link to FurBid from a web site that the user has control over. Depending on the severity of the copyright infraction, the user(s) account(s) may be suspended/deleted, and local law enforcement in the user's area may be alerted

Agreement to terms:Use of FurBid by you indicates that you agree to all above policies, that you have read and understand this page, and that you absolve FurBid and its operators of any and all liability related to the buying or selling of items including, but not limited to: misleading auctions, failure of bidder to pay, failure of seller to ship, libel or slander on the part of buyer or seller. Like any other agreement between two private parties, you use this service at your own risk.
